This book, formed as a series of essays in honour of Professor Carl Baudenbacher, addresses the very art of judicial reasoning, and features contributions from many of the foremost current or former national, supranational, or international judges. This unique volume is intended first and foremost for legal scholars, but its approachable style makes it readily accessible for students and for those with a general interest in the application of the law and justice in today's multi-layered world. The collection of essays (...) is rather more philosophical and reflective as opposed to doctrinal. Each contribution focuses on the nature and operation of justice, the independence of the judiciary, and on judicial style primarily from the perspective of the judges themselves. The book provides perspectives on what it means to be accountable and independent as a judge, the role of language and languages in the quest for justice, while other contributions acquaint readers with the some of the structures of courts themselves, or indeed question for whom judgments are written. Health authorities increasingly request that general practitioners use information and communication technologies such as electronic patient records for accountability purposes. This article deals with the use of EPRs among general practitioners in Britain. It examines two ways in which GPs use the EPR for accountability purposes. One way is to generate audit reports on the basis of the information that has been entered into the record. The other is to let the computer intervene in the clinical process through prompts. The (...) article argues that GPs' ambivalence toward using the EPR makes them active in finding ways that turn the EPR into a meaningful tool for them, that is, a tool that helps them provide what they see as good care. The article's main contribution is to show how accountability and autonomy are coproduced; less professional autonomy does not follow from more requests to document one's work. Instead, new forms of autonomy are produced in the sociotechnical network that is made up by health policy and local engagements with patients and technology. (shrink)

Human cognition is unique in the way in which it relies on combinatorial (or compositional) structures. Language provides ample evidence for the existence of combinatorial structures, but they can also be found in visual cognition. To understand the neural basis of human cognition, it is therefore essential to understand how combinatorial structures can be instantiated in neural terms. In his recent book on the foundations of language, Jackendoff described four fundamental problems for a neural instantiation of combinatorial structures: the massiveness (...) of the binding problem, the problem of 2, the problem of variables, and the transformation of combinatorial structures from working memory to long-term memory. This paper aims to show that these problems can be solved by means of neural “blackboard” architectures. For this purpose, a neural blackboard architecture for sentence structure is presented. In this architecture, neural structures that encode for words are temporarily bound in a manner that preserves the structure of the sentence. It is shown that the architecture solves the four problems presented by Jackendoff. The ability of the architecture to instantiate sentence structures is illustrated with examples of sentence complexity observed in human language performance. Similarities exist between the architecture for sentence structure and blackboard architectures for combinatorial structures in visual cognition, derived from the structure of the visual cortex. These architectures are briefly discussed, together with an example of a combinatorial structure in which the blackboard architectures for language and vision are combined. In this way, the architecture for language is grounded in perception. Perspectives and potential developments of the architectures are discussed. These last years, the development of AI robots for agriculture, livestock farming and food processing industries is rapidly increasing. These robots are expected to help produce and deliver food more efficiently for a growing human population, but they also raise societal and ethical questions. As the type of questions raised by these AI robots in society have been rarely empirically explored, we engaged in four case studies focussing on four types of AI robots for agri-food ‘in the making’: manure collectors, (...) weeding robots, harvesting robots and food processing robots which select and package fruits, vegetables and meats. Based on qualitative interviews with 33 experts engaged in the development or implementation of these four types of robots, this article provides a broad and varied exploration of the values that play a role in their evaluation and the ethical questions that they raise. Compared to the recently published literature reviews mapping the ethical questions related to AI robots in agri-food, we conclude that stakeholders in our case studies primarily adopt a relational perspective to the value of AI robots and to finding a solution to the ethical questions. Building on our findings we suggest it is best to seek a distribution of tasks between human beings and robots in agri-food, which helps to realize the most acceptable, good or just collaboration between them in food production or processing that contributes to realizing societal goals and help to respond to the 21 century challenges. Various issues concerning the neural blackboard architectures for combinatorial structures are discussed and clarified. They range from issues related to neural dynamics, the structure of the architectures for language and vision, and alternative architectures, to linguistic issues concerning the language architecture. Particular attention is given to the nature of true combinatorial structures and the way in which information can be retrieved from them in a productive and systematic manner.

We discuss a visual blackboard architecture that could be involved in imagery. In this architecture, networks that process identity information interact with networks that process location information, in a manner that produces structural (compositional) forms of representation. Architectures of this kind can be identified in the visual cortex, but perhaps also in prefrontal cortex areas related with working memory.

Cet article offre une analyse succincte des œuvres critiques de Ramus contre les deux grands rhéteurs de l’ancienne Rome, Cicéron et Quintilien, les Brutinae Quaestiones in Oratorem Ciceronis de 1547 et les Rhetoricae Distinctiones in Quintilianum de 1549. Ces œuvres se présentent comme des commentaires textuels, mais elles ne constituent pas une contribution substantielle à l’étude philologique des deux traités antiques. Elles semblent plutôt avoir pour but de montrer que, selon Ramus, la rhétorique ne concerne que l’élocution et l’action, et (...) que la séparation stricte des arts du Trivium au niveau de la théorie est la seule méthode appropriée pour les enseigner. Cognitive agents are dynamical systems but not quantitative dynamical systems. Quantitative systems are forms of analogue computation, which is physically too unreliable as a basis for cognition. Instead, cognitive agents are dynamical systems that implement discrete forms of computation. Only such a synthesis of discrete computation and dynamical systems can provide the mathematical basis for modeling cognitive behavior.

This article is part of the Dossier on Tacitus published in last year's issue of Grotiana. It offers a combined study of both the content and the language and style of Grotius' account of the capture of Breda in the second book of the Historiae, published in 1657 together with the Annales under the title Annales et Historiae de rebus Belgicis. A thorough analysis of Grotius' account of this eventful and dramatic turning point in the Dutch revolt reveals that it (...) is nothing but a defective and occasionally unclear rehearsel of the standard narrative of the capture based on the well-known and in Grotius' day widely read history-books written in French and Dutch. The rather artificial imitation of Tacitus's brevitas on the stylistic level does not suffice to qualify Grotius's account as a masterful piece of Tacitean writing, because it does not highlight the motives of the chief characters in the story nor the connection between the events and their effects, and because Grotius fails to present his own perspective on this important episode in the war against Spain. We discuss the role of synchrony of activationin higher-level cognitive processes. Inparticular, we analyze the question of whethersynchrony of activation provides a mechanismfor compositional representation in neuralsystems. We will argue that synchrony ofactivation does not provide a mechanism forcompositional representation in neural systems.At face value, one can identify a level ofcompositional representation in the models thatintroduce synchrony of activation for thispurpose. But behavior in these models isalways produced by means conjunctiverepresentations in the form of coincidencedetectors. Therefore, models that rely onsynchrony (...) of activation lack the systematicityand productivity of true compositional systems.As a result, they cannot distinguish betweentype and token representations, which resultsin misrepresentations of spatial relations andpropositions. Furthermore, higher-levelcognitive processes will likely integrateinformation from widely distributed areas inthe brain, which puts severe restrictions onthe underlying neural dynamics if synchrony ofactivation is to play a role in theseprocesses. This article challenges the general thesis that an unconditional basic income, set at the highest sustainable level, is required for maximizing the income-leisure opportunities of the least advantaged, when income varies according to the responsible factor of labor input. In a linear optimal taxation model (of a type suggested by Vandenbroucke 2001) in which opportunities depend only on individual productivity, adding the instrument of a uniform wage subsidy generates an array of undominated policies besides the basic income maximizing policy, including (...) a “zero basic income” policy which equalizes the post-tax wage rate. The choice among such undominated policies may be guided by distinct normative criteria which supplement the maximin objective in various ways. It is shown that most of these criteria will be compatible with, or actually select, the zero basic income policy and reject the basic income maximizing one. In view of the model's limited realism, the force of this main conclusion is discussed both in relation to Van Parijs' argument for basic income in Real Freedom for All (1995) and to some key empirical conditions in the real world. Logical puzzles like the doctrinal paradox raise the problem of how to aggregate individual judgements into a collective judgement, or alternatively, how to merge collectively inconsistent knowledge bases. In this paper, we view judgement aggregation as a function on propositional logic valuations, and we investigate how logic constrains judgement aggregation. In particular, we show that there is no non-dictatorial decision method for aggregating sets of judgements in a logically consistent way if the decision method is local, i.e., only depends on (...) the individual judgements on the proposition under consideration. En 1893, « physicien-ingénieur » André Blondel invente l’oscillographe bifilaire permettant de visualiser les tensions et courants variables. À l’aide de ce puissant moyen d’investigation, il entreprend tout d’abord l’étude des phénomènes de l’arc électrique alors utilisé pour l’éclairage côtier et urbain puis de l’arc chantant employé comme émetteur d’ondes radioélectriques en T.S.F. En 1905, il met en évidence un nouveau type d’oscillations non-sinusoïdales au sein de l’arc chantant. Vingt ans plus tard, Balthasar Van der Pol reconnaitra qu’il s’agissait en (...) réalité d’oscillations de relaxation. Pour expliquer ce phénomène, il fait appel à une representation dans le plan de phase et montre que son évolution prend la forme de petits cycles. Pendant le premier conflit mondial la triode remplace peu à peu l’arc chantant dans les systèmes de transmission. Au sortir de la guerre, Blondel transpose à la triode la plupart de ses résultats par analogie avec l’arc chantant. En avril 1919, il publie un long mémoire dans lequel il introduit la terminologie « oscillations auto- entretenues » et propose d’illustrer ce concept à partir de l’exemple du vase de Tantale qui sera ensuite repris par Van der Pol et par Philippe Le Corbeiller. Il fournit alors une définition d’un système auto-entretenu assez proche de celles qui seront données par la suite par Aleksandr’ Andronov et Van der Pol. Pour étudier la stabilité des oscillations entretenues par la triode et par l’arc chantant il utilise cette fois une représentation dans le plan complexe et explicite l’amplitude en coordonnées polaires. Il justifie alors l’entretien des oscillations par l’existence de cycles qui présentent presque toutes les caractéristiques des cycles limites de Poincaré. Enfin, en novembre 1919, Blondel réalise, un an avant Van der Pol, la mise en équation des oscillations d’une triode. En mars 1926, Blondel établit l’équation différentielle caractérisant les oscillations de l’arc chantant, en tous points similaire à celle qu’obtient concomitamment Van der Pol pour la triode. Ainsi, tout au long de sa carrière, Blondel, a apporté une contribution fondamentale et relativement méconnue à l’élaboration de la théorie des oscillations non linéaires. L’objet de cet article est donc d’analyser ses principaux travaux dans ce domaine et de mesurer leur importance, voire leur influence en les replaçant dans la perspective du développement de cette théorie. We investigate the notion of minimal cognition, and claim that this notion already applies to bacterial behavior. On the basis of the example of E. coli, we argue that the basis of cognition can be profitably cast as sensorimotor coordinations which subserve the metabolic requirements of organisms.

This paper makes a contribution to the further development of the game-theoretic analysis of rights. The model presented here differs in several respects from the existing models. First of all, a distinction is made between outcome-oriented and action-oriented rights, a distinction which is closely related to the distinction between active and passive rights. Second, the legal-theoretic notions of negative and positive rights are formally defined. Third, we not only discuss the definition of rights, but also the way rights can be (...) violated. Using the distinction between negative and positive rights on the one hand, and between active and passive rights on the other, four different types of basic rights are distinguished. For each of these rights, the situations in which they can be said to be respected are examined. We thereby distinguish two possible sources of obstruction: by (groups of) individuals, and by law. Finally, the question of the possible realization of rights is examined. Depending on how the problem of the possible mutual incompatibility of rights is addressed, two distinct approaches are examined. It turns out that in both approaches the possible realization of rights crucially depends on characteristics of the 'state of nature'. (shrink)

In order to overcome the unhealthy perspective of body-mind dualism and become capable of holding the “higher” and healthier perspective of body and mind as will to power, Nietzsche stresses that one must engage in a process of cultivation of the body. Such a practice of self-cultivation involves leaving behind incorporated illusory and life-denying perspectives and incorporating more “truthful” and affirmative perspectives on life. In this article, Nietzsche’s views on the body and its cultivation will be further explored and compared (...) with Japanese Buddhist thought on body, mind, and cultivation. In Japanese thought, the notion of shinjin-ichinyō (oneness of body and mind) was developed in order to overcome a dualistic approach to body and mind. The unity of body and mind plays an essential part in the philosophies of both Kūkai and Dōgen. Whereas in early Indian Buddhism, self-cultivation took place primarily through the mind (citta), in Japanese Buddhist practice the body, not the mind, is the primary locus as exemplified in Dōgen’s somatic practice of zazen. Although from the everyday perspective, body and mind are experienced as two separate things, a higher perspective is possible in which body-mind is experienced as a continually changing configuration of dharmas that doesn’t contain any “I.” Such a higher perspective is called “samadhic awareness” by Dōgen, in which “body and mind are cast off” (shinjin totsuraku). For both Nietzsche and Dōgen, their “philosophy am Leitfaden des Leibes” does not aim at discovering “truths” by means of introspection and thinking, but at increasing the body’s capacity for the incorporation of new and liberating perspectives. The modern critical approach to things hagiographical still wavers when it comes to taking leave of twelve lines of iambic invective, branded with wonderful delicacy of touch on the saintly foreheads of two Palestinian brothers, Theodore and Theophanes, the so-called “Graptoi”. Barry Baldwin, noting that C.A. Trypanis, unlike the great B. Bury and others, was inclined to disbelieve the story, could not help expressing the hope that it was true (An Anthology of Byzantine Poetry, Amsterdam 1985, pp. 142–3). It is (...) of course only one of the many stories concocted by iconodule propaganda. The central question has to be formulated in more general terms: how is history made? History here primarily in the sense of the construction of the past by the Byzantines themselves, was embodied in historical narratives moving between hagiography and historiography. Trying to lay bare the basis and elements of such constructs will always remain a major task of critical historical scholarship. (shrink)

We analyze the cognitive strategies underlying performance in the Number task, a Math game that requires both arithmetic fluency and mathematical creativity. In this game all elements in a set of numbers have to be used precisely once to create a target number with basic arithmetic operations. We argue that some instances of this game are NP complete, by showing its relation to the well-known Partition problem. We propose heuristics based on the distinction in forward and backward reasoning. The Number (...) Game is part of Math Garden, a popular online educational platform for practicing and monitoring math skills using innovations in computerized adaptive testing. These educational games generate enormous amounts of rich data on children's cognitive development. We found converging evidence for the use of forward proximity heuristics in the data of Math Garden, consisting of more than 20 million answers to 1,700 items. Item difficulties and the structure of correct answers were analyzed. (shrink)

To understand pre-Fregean theories of judgment and proposition, such as those found in Locke and the Port-Royal logic, it is important to distinguish between propositions in the modern sense and propositions in the pre-Fregean sense. By making this distinction it becomes clear that these pre-Fregean theories cannot be meant to solve the propositional attitude problem. Notwithstanding this fact, Locke and Arnauld are able to make a distinction between asserted and unasserted propositions (in their sense). The way Locke makes this distinction (...) turns out to be very different from the way it is made by Arnauld. (shrink)

Background Notwithstanding the need to produce evidence-based knowledge on medications for pregnant women, they remain underrepresented in clinical research. Sometimes they are excluded because of their supposed vulnerability, but there are no universally accepted criteria for considering pregnant women as vulnerable. Our aim was to explore whether and if so to what extent pregnant women are vulnerable as research subjects. Method We performed a conceptual and empirical analysis of vulnerability applied to pregnant women. Analysis A conceptual analysis supports Hurst's definition (...) of vulnerability. Consequently, we argue that pregnant women are vulnerable if they encounter an identifiably increased likelihood of incurring additional or greater wrong. According to the literature, this increased likelihood could exist of four alleged features for pregnant women's vulnerability: informed consent, susceptibility to coercion, higher exposure to risk due to lack of knowledge, vulnerability of the fetus. Discussion Testing the features against Hurst's definition demonstrates that they all concern the same issue: pregnant women are only vulnerable because a higher exposure to risk due to lack of scientific knowledge comprises an increased wrong. Research Ethics Committees have a responsibility to protect the vulnerable, but a higher exposure to risk due to lack of scientific knowledge is a much broader issue and also needs to be addressed by other stakeholders. Conclusions The only reason why pregnant women are potentially vulnerable is to the extent that they are increasingly exposed to higher risks due to a lack of scientific knowledge. Accordingly, the discussion can advance to the development of practical strategies to promote fair inclusion of pregnant women in clinical research. (shrink)

Over the past decades, both wild and domesticated insect pollinators are in dramatic decline, which puts at stake the existence of species, ecosystem resilience and global food security. Globally, 87 of major food crops depend on animal pollination. Together these account for 35 % of the world food production volume. Pollinator mediated crops are indispensable for essential micronutrients in the human diet. Many ornamental plants as well as crops for fibre, fodder, biofuels, timber and phytopharmaceuticals also depend on insect pollinators. (...) This article aims to map the current situation of pollinators worldwide, with a focus on the critical role of pollinators in the human food chain and ecosystem sustainability, their intrinsic and extrinsic value, as well as the causes of their declines and the interventions needed to conserve them, in order to develop an argument for the importance of conserving and restoring pollinator populations and diversity. The present pollinator crisis threatens global and local food security, can worsen the problems of hidden hunger, erodes ecosystem resilience, and can destabilise ecosystems that form our life support system. An integrated approach that simultaneously addresses the key drivers is needed. This includes creation and restoration of floral and nesting resources, a global phase out of prophylactic use of neonicotinoids and fipronil, improvement of test protocols in authorisation of agrochemicals, and restoration and maintenance of independence in regulatory science. The authors argue that an international treaty for global pollinator stewardship and pollinator ecosystem restoration should be initiated in order to systemically counteract the current crisis. Both the concept of a Darwinian tree of life (TOL) and the possibility of its accurate reconstruction have been much criticized. Criticisms mostly revolve around the extensive occurrence of lateral gene transfer (LGT), instances of uptake of complete organisms to become organelles (with the associated subsequent gene transfer to the nucleus), as well as the implications of more subtle aspects of the biological species concept. Here we argue that none of these criticisms are sufficient to abandon the valuable TOL concept (...) and the biological realities it captures. Especially important is the need to conceptually distinguish between organismal trees and gene trees, which necessitates incorporating insights of widely occurring LGT into modern evolutionary theory. We demonstrate that all criticisms, while based on important new findings, do not invalidate the TOL. After considering the implications of these new insights, we find that the contours of evolution are best represented by a TOL. (shrink)
